Ask Judge Sotomayor

Posted by: Staff in Judges on Print

Senator Hatch wants to give an opportunity to participate in the U.S. Senate's confirmation hearings for Judge Sonia Sotomayor's nomination to the U.S. Supreme Court by submitting a question for Judge Sotomayor.

Senator Hatch explains:

I would like to give you the opportunity to participate in Judge Sotomayor's hearings this week by emailing me any questions you would like to see asked at the hearing. Although I cannot guarantee your question will be asked, I will certainly review the questions you submit and see if there is an opportunity to use them during the course of the hearings.

Please email your questions to askjudgesotomayor@hatchforsenate.com.

A question for Judge Sotomayer
written by Georgia L. Mackowiak, July 13, 2009
Because Judge Sotomayer continues to make an issue of her ethnicity and minority status, does the Judge believe that she can render fair and impartial opinions in cases involving persons of all races, ethnicities and socio-economic backgrounds if she becomes a Supreme Court Justice? If she believes she can be impartial, upon what factors does she base this belief?

Thank you for reviewing every day American questions we have for Judge Sotomayor.

I would like to ask Judge Sotomayor when life begins, scientifically speaking? Also with the new technology we have to see exactly when human life begins, when do we have an obligation to protect human life?

The Declaration of Independence is clear people are "endowed by their Creator with certain unalienable Rights, that among these are Life,..."

All human life should be protected under the law as stated in the Declaration of Independence, what is Judge Sotomayor's view of this?

Pres. Obama said that answer is above his paygrade, but embryologists say science answers that question for us -

Based on universally accepted scientific criteria, a new cell, the human zygote, comes into existence at the moment of sperm-egg fusion, an event that occurs in less than a second. Upon formation, the zygote immediately initiates a complex sequence of events that establish the molecular conditions required for continued embryonic development. The behavior of the zygote is radically unlike that of either sperm or egg separately and is characteristic of a human organism. Thus, the scientific evidence supports the conclusion that a zygote is a human organism and that the life of a new human being commences at a scientifically well defined “moment of conception.” This conclusion is objective, consistent with the factual evidence, and independent of any specific ethical, moral, political, or religious view of human life or of human embryos.

A Question to Ask Sotomayor
written by Akrongarber, July 13, 2009
You do not seem to subscribe to the Second Amendment as defining the right of a private citizen to own and bear arms. The following two quotes are from Thomas Jefferson:

"The strongest reason for the people to retain the right to keep and bear arms is, as a last resort, to protect themselves
against tyranny in government."

"No free man shall ever be debarred the use of arms. "

Wouldn't you agree that these quotes indicate that the second amendment was intended, by our Founding Fathers, to apply to ALL Americans not just a Militia? How can "We the People" ensure that we will always have protection under the First Amendment if we did not have the ability to defend it under the Second?

If you do not agree with this logic, please explain yourself.
Thank you

Ask her how many of her cases went to US Supreme Court and were overturned (since you got it wrong on MSNBC today). Then apologize to her for getting it wrong.

"Shall Not Be Infringed"
written by Charles A. Hall, July 14, 2009
My question for Supreme Court nominee Sonia Sotomayor is on the Second Amendment of the United States Constitution:

"Judge Sotomayor, if appointed to the United States Supreme Court you are to follow the Constitution of the United States of America and not personal feelings. With the United States Supreme Court giving a ruling last year (2008) in Heller vs. District of Columbia they found that the Second Amendment is an individual, not collective, right of an American citizen. The Second Amendment in the end says, quote: 'the right of the People to keep and bear arms shall not be infringed.' What is your stance on phrase 'shall not be infringed?'"

2nd amendment rights to State and local governments
written by Sam, the Nanti-SARRMM, July 14, 2009
I believe Sotomayor said that she believes that the 2nd amendment doesn't apply to state and local governments. Can you ask her to clarify her position in regards to how the 2nd amendment applies to state governments, i.e. how it applies to the national guard?
